Welcome to The Fifth Family. By registering for an account, downloading our app, or accessing our game, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access the game.
1. Age Requirement
You must be at least 18 years of age to create an account and use The Fifth Family. By creating an account, you confirm that you are 18 years of age or older. We reserve the right to terminate any account where the user is found to be under 18.
2. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use The Fifth Family for your personal, non-commercial use. This licence does not include the right to:
- Modify, reverse-engineer, decompile, or create derivative works of the game
- Use bots, scripts, macros, auto-refreshers, or any automated tools to interact with the game
- Exploit bugs, glitches, or unintended game mechanics for personal gain
- Sell, trade, or transfer your account to another person
- Access the game through any unauthorised means or circumvent security measures
We reserve the right to revoke this licence and terminate your access at any time for any reason.
3. Account Rules & Restrictions
- One Account Per Person: You are strictly permitted to own and operate exactly one (1) account. Multi-accounting and creating "farm" or "alt" accounts is strictly prohibited and will result in a permanent ban of all associated accounts. Accounts from the same IP (household) can actively play but cannot join through each other's referral. Same-IP trading and transfers are monitored daily to ensure fairness within the game's economy.
- No Automation: The use of bots, macros, auto-refreshers, scripts, or any third-party software designed to automate gameplay is strictly forbidden. For scripts that are harmless and beneficial to the game and your account's management, either The Fifth Family or a trusted creator will publish an official script with the developer's authorisation.
- Account Security: You are responsible for maintaining the confidentiality of your login credentials. The administrators are not responsible for compromised accounts. Although we will do our utmost to recover compromised accounts, if sufficient supporting evidence is not provided to prove you are the rightful owner, the account may be permanently suspended.
4. Player Conduct
While The Fifth Family is a competitive mafia game involving conflict, attacks, and syndicates, behaviour outside of the game's roleplay scope must remain respectful. The following is strictly prohibited:
- Harassment, bullying, or intimidation of other players
- Hate speech, discriminatory language, or threats based on race, gender, religion, sexuality, or any other characteristic
- Doxxing or sharing personal information of other players
- Real-life threats of any kind
- Spamming, advertising, or promoting external products or services in chat or messages
- Impersonating staff members or other players
Violations will result in warnings, temporary suspensions, or permanent bans at the discretion of the moderation team.
5. User-Generated Content
The Fifth Family allows users to communicate through in-game chat, private messages, and group messages. By using these features, you agree that:
- You will not post content that is abusive, threatening, discriminatory, sexually explicit, or illegal
- You will not share personal information of other users
- We reserve the right to monitor, moderate, and remove any user-generated content without notice
- We reserve the right to suspend or ban accounts that violate the conduct rules outlined in Section 4
- You grant The Fifth Family a non-exclusive, royalty-free licence to use, display, and distribute any content you submit through the game's communication features
6. Virtual Currencies & In-App Purchases
The Fifth Family offers virtual currencies (Platinum, Mafia Gold) and virtual items that can be purchased with real money through the Apple App Store or Google Play Store. By making a purchase, you acknowledge that:
- No Real-World Value: In-game cash, properties, items, Mafia Gold, and Platinum hold no real-world monetary value and cannot be exchanged, refunded, or transferred for real money
- All Purchases Are Final: All purchases are final unless required otherwise by applicable law or the refund policies of Apple or Google
- Licensed, Not Sold: Virtual currencies and items are licensed to you, not sold, and remain the property of The Fifth Family
- Modifications: We reserve the right to modify, manage, regulate, or eliminate virtual currencies and items at any time
- Forfeiture: If your account is deleted or terminated, all virtual currencies and items will be forfeited
- Real-World Trading (RWT): Buying, selling, or trading any in-game assets, accounts, or currencies for real-world money is strictly prohibited
Refund requests should be directed to Apple or Google, as they handle all payment processing.
7. Simulated Gambling
The Fifth Family contains simulated gambling features (casino games) that use in-game virtual currency only. No real money is wagered, won, or lost through these features. Virtual currency won through casino games has no real-world value and cannot be exchanged for real money. These features are intended for entertainment purposes only and do not constitute real gambling.
8. Account Deletion
You may request deletion of your account at any time by submitting a Support Ticket in-game or by emailing support@thefifthfamily.com. Account deletion requests will be processed within 30 days.
Upon deletion:
- Your account and all associated data will be permanently removed
- All virtual currency, items, and in-app purchases will be forfeited with no refund
- Your username will become available for future use by other players
- Any active premium passes or memberships will be cancelled
We reserve the right to retain anonymised gameplay data for analytics purposes and financial transaction records as required by applicable law.
9. Intellectual Property
All content within The Fifth Family — including but not limited to graphics, artwork, text, game mechanics, code, audio, and design — is the intellectual property of The Fifth Family and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any of our content without prior written consent.
10. Modifications to the Service
We reserve the right to modify, update, suspend, or discontinue any aspect of the game at any time, with or without notice. This includes changes to game mechanics, virtual economies, features, and content. We are not liable for any loss of virtual items, currency, or progress resulting from such changes.
11. Termination
We reserve the right to suspend or terminate your account at any time, without notice, for any violation of these Terms of Service or for any behaviour deemed harmful to the game's community or infrastructure. Upon termination, all rights granted to you under these Terms will immediately cease.
12. Limitation of Liability
The Fifth Family is provided on an "as is" and "as available" basis. To the fullest extent permitted by law:
- We make no warranties regarding the availability, reliability, or accuracy of the game
- We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the game
- Our total liability to you for any claims arising from or related to the game shall not exceed the amount you have paid to us in the 12 months preceding the claim
- We are not responsible for any loss of virtual items, currency, or progress due to technical issues, server maintenance, or circumstances beyond our control
14. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
15. Modifications of Service
Modifications to the Service The administrators reserve the right to modify, suspend, or discontinue any aspect of the game at any time.
16. Changes to These Terms
We may update these Terms of Service from time to time. If we make significant changes, we will notify you through an in-game notification or by posting a notice on our website. Your continued use of the game after any changes constitutes your acceptance of the updated Terms.
